Bank Asset Funds: General Regulatory Provisions and Tax Regime

In the context of the restructuring and recapitalization of the Spanish banking sector, the Spanish authorities, in addition to other measures such as increasing minimum capital requirements and reorganizing the savings bank sector, have established the structure and characteristics of the ad hoc asset management company (SAREB) for assets arising from bank restructuring. This article analyses the tax regime applicable to bank asset funds and the tax treatment of investments in this new investment vehicle.
