This article reports on a recent High Court decision in which a request under the exchange of information provisions in the Australia-South Africa Income Tax Treaty (1999) were enforced regarding a non-resident who is not a taxpayer in South Africa. It is understood that the case has been appealed and the final decision is, therefore, still awaited.
