On 16 July 1998 the European Court of Justice (ECJ) handed down its decision in Imperial Chemical Industries plc (ICI) v. Kenneth Hall Colmer (Her Majesty's Inspector of Taxes). The case concerned the interpretation of Articles 5 and 52 of the EC Treaty. This paper outlines the facts of the ICI case, the points at issue and the ECJ's judgment thereon.
