Restrictions on Treaty Override Resulting from EU Law

This article examines the interrelationship between the issue of treaty override and EU law. In particular, the author examines the influence of the fundamental freedoms of the Treaty on the Functioning of the European Union on treaty override, the ECJ's continued reluctance to give a ruling in this area and the potential impact of secondary EU law.
