This article analyses Circular 23 of 1969, issued by the Central Board of Direct Taxes, and connected provisions under the Indian Income Tax Act. Also considered are the impact of the withdrawal of Circular 23 on the judicial decisions of Indian courts and the effect on taxation of non-residents having business in India.
